Terms and Conditions of Sale

These terms and conditions are the entire agreement between the Museum of Latin American Art (MOLAA) and the purchaser relative to the property listed herein. By bidding using GiveSmart or by doing so in person at the MOLAA Gala during the Live Auction on Friday, October 5, you agree and consent to the following:

1.       Proceeds from MOLAA's live and silent auctions benefit exhibitions and education programs at MOLAA.

2.       All bidders must register on MOLAA's Give Smart webpage to bid on items in either the live or silent auction and additional philanthropic opportunities offered during the Gala All purchases will be processed using the credit card used when registering on GiveSmart.

3.       Each bid placed will constitute a legal offer, which, on acceptance by MOLAA through GiveSmart, will form an agreement that will be binding on behalf of the individual placing the bid.

4.       Unless exempted by law, the purchaser will be required to pay California state, county and local sales taxes, which are currently 10.25% in Long Beach.

5.       All auction items must be retrieved from MOLAA's possession by the purchaser not later than 15 days after the event date (and no later than October 20, 2018). MOLAA will pack and ship purchased lots for purchasers with an agreement from the purchaser to pay all expenses and limit MOLAA's liability; agreements will be made in person, or via e-mail if online purchase, prior to packing and shipping of items or artwork.

6.       All lots are sold "as is" and all sales are final.

Live Auction Bidding:

1.       All biding must be done during the Gala Friday, October 5.

2.       Each lot is offered subject to a reserve, which is the confidential minimum price below which such lot will not be sold.

3.       For the live auction, bidders will receive a numbered paddle for identification during the bidding and as an instrument with which to make their bids.

4.       The highest bidder as acknowledged by the auctioneer will be the purchaser, and on the fall of the auctioneer's hammer, title to the offered lot will pass to the purchaser. The auctioneer has final discretion to determine the successful bidder/purchaser.

Access to and participation by you in the Auction is confirmation that you have read and accepted the above Terms and Conditions.
