Sandberg Phoenix Estate Plan

An Estate Plan and Special Needs Trust to make sure you and your family are prepared and protected. Your plan will include the following:

  • FINANCIAL DURABLE POWER OF ATTORNEY The durable power of attorney covers personal and financial matters and appoints an attorney-in-fact to act on your behalf if you are unable to do so.
  • HEALTHCARE DECLARATION AND LIVING WILL The healthcare declaration names an individual to make medical decisions for you in the event you are unable to do so. Your Living Will provides that if you are in a terminal condition, diagnosed with a coma or persistent vegetative state t is concluded to be irreversible, or have substantial brain damage or disease t cannot be significantly reversed, it is your desire that life support be withdrawn.
  • LAST WILL AND TESTAMENT The last will and testament is the roadmap used by the probate court to determine the disposition of assets; it does not avoid probate. If you have minor children, you will name an individual to act as guardian for your minor children in the event you are unable to do so.
  • REVOCABLE TRUST A revocable trust will hold your assets during your lifetime and will help to avoid probate and to ensure the transition of your estate to your spouse and/or descendants. Revocable trusts can be amended and/or restated at any time while you are able to do so. You can make the trust as restrictive or unrestrictive for the beneficiaries as you would like. Lifetime trusts (highly recommended) for your children and more remote descendants, protect the Trust assets against the potential for divorce and creditors.
  • SPECIAL NEEDS TRUST A Special Needs Trust is tailored to a person with special needs that is designed to manage assets for that person's benefits and still maintain eligibility of public benefits. A properly drafted special needs trust will allow the beneficiary to receive government benefits while still receiving funds from the trust. Every person with special needs is different, which means that every special needs trust is going to be different as well. We are here to ensure you receive up-to-date information regarding state and federal benefits and to make sure your family is protected by preparing a special needs trust specifically for your family.
