TERMS OF SALE

Cash or check unless prior arrangements are made. No cattle will be released until paid in full. Cattle will not be transferred into the buyer's name until paid in full. Each animal becomes the purchaser's risk as soon as sold. The right to flush will be done so at the convenience of the buyer and expense of the consignor.

SALE CONDITIONS

• Each animal will be sold to the highest bidder. The auctioneer will settle any disputes as to bids, and decisions on such matters will be final. Each animal will be at purchaser's risk as soon as sold and will be turned over to the purchaser as soon as practicable after settlement. 

• Buyers have the option of leaving females at Freking Cattle and having them exhibit the heifers at the national shows.

• Buyer must insure their purchase while being in the care of Freking Cattle.

• Due to increased feed costs, an additional $33/day will be charged while the heifer is at the ranch, beginning November 1, 2025.

• Any banners, ribbons or hardware won will belong to the buyer.

• Buyer will take possession after the respective show and will be responsible for arranging transportation.

• Retain Two Flush Option: If shown, the buyer will pay full show expense. Freking Cattle will retain the right to flush the female twice after she is in production, at the buyer's convenience, for a minimum of six No. 1 eggs.

• Freking Cattle retains the right to two flush's on all females in the auction.

TRANSPORTATION

Buyers are responsible for shipping expenses. We will help coordinate shipping to combine possible loads. Cattle will be kept for a reasonable length of time following the sale until delivery or pick up can be made.

GUARANTEE

All cattle are guaranteed to be breeders. In case an adjustment is required, it will be made with a replacement animal of equal value to the animal in question or credit on the purchase of another animal. If any open heifer fails to breed or make embryos, the seller must be notified by October 1, 2026, otherwise, the animal is no longer guaranteed. All cattle sell under the Sale Terms and Conditions recommended by the American Hereford Association. See www.hereford.org. All cattle in this sale are guaranteed in accordance with the rules and regulations of the American Hereford Association.

This Auction has a horse race style finish. Every time someone bids during the last 5 minutes of the auction the clock will extend 5 more minutes until no one bids for an entire 5 minutes. Please note that this countdown duration may be changed without notice during the auction.

SmartAuctions will invoice all buyers and release the lot after payment is received. PAYMENT IS DUE UPON RECEIPT. A credit/debit card will be required ONLY to verify identity of bidders, but you will not be charged for your purchases on your card UNLESS you choose that option or you have not paid for your purchases prior to 12 days after the auction closes. Your credit card will be charged if payment has not been received within 12 days after purchase or arrangements have not been communicated. If your credit card payment is declined at the 12 days your purchase will accrue an interest of 6%. If you pay with a card you will be charged a 5% transaction fee.
