Terms and Conditions 
Thank you for signing up for the “Stories from the Spectrum” 2020 Event. Proceeds from this event will benefit the West Virginia Autism Training Center (WVATC), including the College Program for Students with Autism Spectrum Disorder (CPSASD). Please read the following Terms and Conditions. 
 
Bidding 
All prospective bidders must be at least 18 years old and, prior to placing a bid, will be required to create a GiveSmart Auction bid account and provide all required information to register. 
 
Consent to Receive Text Messages 
By supplying your mobile device number, you agree to receive text messages about the event for which you are registering, as well as information regarding the auction and the status of your bids from GiveSmart. Agreement to receive this information is not required to register for an event or place a bid at an auction. 
 
Consent for Data Capture 
By registering for this event, you agree that WVATC and GiveSmart may capture and use your personal data in accordance with the GiveSmart Notice of Privacy Practices, which is incorporated by reference in its entirety in these Terms. (You may revoke this consent at any time.) 
 
Credit Card on Account 
By placing your credit card on file through GiveSmart, you agree to your credit card being charged following the event for the balance on your account. 
 
Responsibility for Purchases 
By bidding on an item in the auction, you agree to purchase the item, should you win. All bids are final and binding at the close of the auction. If a bid is made in error you can request for WVATC to remove the bid BEFORE THE CLOSURE OF THE AUCTION. Bid removal will be at the sole discretion of the West Virginia Autism Training Center. 
 
Item Information  
All items are sold “as is” and are subject to conditions and terms stipulated by the donor. Every effort is made to describe items as clearly as possible. Please pay particular attention to expiration/event dates. No exchanges, substitutions or refunds will be honored. The auction item values listed are estimates of fair market value (FMV) as estimated by the donor and are not warranted by WVATC.  Items have not been appraised unless so noted. 
 
Tax Deductibility 
The amount the purchaser pays above the FMV estimate may be tax deductible as a charitable contribution. Determining the appropriate deduction is the responsibility of the purchaser. Please consult your tax adviser to clarify amount of deduction. You may receive a tax letter and receipt upon request.

ANY ACT OR ATTEMPT BY A PERSON TO UNDERMINE THE LEGITIMATE OPERATION OF ANY AUCTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, EACH AUCTIONEER RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY LAW.
