NYCWFF Online Charitable Auction Terms and Conditions

The Food Network & Cooking Channel New York City Wine & Food Festival presented by Capital One (NYCWFF) will host a 7-day online auction ("NYCWFF presents the Online Wine Auction Experience") raising funds to support the fight to end hunger with No Kid Hungry and Food Bank For New York City. The Festival will host the auction under a charitable permit issued by The New York State Liquor Authority, where proceeds will go toward No Kid Hungry and Food Bank For New York City.

 

GENERAL: All items are sold "as is". No returns will be accepted and no refunds permitted. The law of the State of NY shall govern with respect to all auction sales. ALL bids are final and cannot be removed. Any individual bidding on alcohol items represents that he/she is acting in compliance with all federal, state, and local laws regarding the purchase, transportation, and delivery of alcohol. All federal, state, and local laws and regulations apply.  By participating in the Auction, each consumer accepts and agrees to comply with and abide by these Official Rules.

Bidders will have the opportunity to bid on up to 15 unique wine lots from Monday, October 5th through Monday, October 12, 2020. The online auction will conclude at 5:00 p.m. (EDT) on Monday, October 12, 2020. The final bidder at 5pm on Monday, October 12th will be awarded as "winning bidder". The Festival team will connect the "winning bidder" with the winery to arrange for shipping, following the close of the auction and once payment has been confirmed. All the accompaniments will be sent separately, either electronically or in the mail.


SHIPMENT: Winner authorizes Festival to act on its behalf to engage wineries to deliver Winner's shipment to its selected destination. Shipment of wine is available to the following states: Arizona, California, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Mexico, New York, North Carolina, North Dakota, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Virginia, Washington, Wisconsin, Wyoming. Winner is responsible and liable for ensuring the accuracy of his/her shipping address. All wines will be shipped directly from the wineries and will be coordinated between the winning bidder and winery, after the close of the auction.

 

WINE LOTS: Wine Lots are described in this catalog as correctly as can be ascertained at the time of the auction. Buyers of wine lots must make appropriate allowances for natural variations of ullage, conditions of cork and wine, other consequences of age and storage. No returns will be accepted and no refunds permitted.

 

PAYMENT: Each buyer must pay the full purchase price of each lot purchased, including any applicable taxes, at the close of the auction. Payments may be made with Capital One - The Official Festival Card, MasterCard, American Express or Visa. Winners with declined cards will have 3 business days to provide an alternate form of payment- after that time, auction lots will be offered to the next highest bidder.

 

AGE REQUIREMENT: Alcohol purchasers must be 21 or over. The Festival makes every effort to ensure that alcohol is not delivered to any individual under the age of 21. Winner is responsible for ensuring that an individual over the age of 21 is present at the shipping address to receive and sign for the delivery and is not intoxicated at the time of delivery. Winner also agrees that any alcohol won from a Festival Auction is for personal consumption and not for resale.

 

Any dispute related to this Auction shall be governed by and interpreted in accordance with the laws of the State of New York, and any legal action regarding it or its terms shall be brought in the state or federal courts located in the City of New York.
