Mentis Auction Terms and Conditions

Thank you for participating in the Mentis Blue Skies Ahead Event! Your participation supports the essential mental health services provided by Mentis in Napa County and beyond. By registering to participate in this auction and/or attend the event, you agree to adhere to the following terms and conditions:

1. To bid on lots containing wine or experiences including wine (such as tastings), you must be at least 21 years of age.

2. Date, time, and location restrictions may apply to some auction lots. Beverages, gratuities, and tax may not be included in some packages. Please check each lot description for full details. All dates shall be mutually agreeable to both the donor and buyer. Travel and shipping are not included in the auction lots unless otherwise noted in the description.

3. Payment for all auction lots must be made in full by cash, check, or credit card at the conclusion of the auction. Mentis staff are available to assist winning bidders with their purchases if desired. If no payment for auction winnings has been received within four (4) months of the auction closing, Mentis reserves the right to repurpose the auction lot for future fundraising purposes.

4. Sales tax will be added as a percentage of the final purchase price if the auction lot is taxable, in accordance with California and Napa County law.

5. Generally, when the purchase price of an auction lot is higher than the stated value, the difference between the two is tax-deductible. Values assigned to some items are estimates only and not warranted by Mentis for tax purposes for general value. Please consult your personal tax advisor about current tax regulations.

6. All sales are final and are subject to the terms and conditions stipulated by the donor of the auction lot. No refunds or exchanges on auction items are permitted. All items have been donated to Mentis and are sold by the organization, not by the donor.

7. Mentis warrants neither the quality nor value of items and services auctioned. All items are sold “as is” and “with faults or charms."

8. Lots are available for pick-up or delivery once payment has cleared. Lot fulfillment, pickup, and/or shipping, including any applicable costs, are the responsibility of the buyer. Mentis will connect any winners who wish to ship their auction items with a shipping company. Please note that we cannot ship to Utah or Mississippi; additional costs may apply to Michigan, Pennsylvania, Virginia, and New Hampshire. Any lots containing hard liquor cannot be shipped and are for local pick-up only. If paid-for lots are not picked up within six (6) months of the auction close date, Mentis reserves the right to repurpose the auction lot for future fundraising purposes.

Winners will have the option to pick up their lot(s) at 1272 Hayes Street in Napa, starting 1 week following the close of the auction. More information will be sent to all winning bidders after auction close.
