*Delivery/Transportation is included for destinations up to 1 hour drive from St. Louis City. Beyond 1 hour drive from St. Louis City, transportation is the financial responsibility of the winner.
*Winner will be randomly selected at the Stray Rescue Golf Tournament on Tuesday, September 9th - winner does not need to be present to win.
*Stray Rescue Employees and their spouses are prohibited from participating.
Winner shall indemnify, defend, and hold harmless Stray Rescue of St. Louis ("SRSTL"), along with
SRSTL's affiliates and their respective officers, directors, employees, and agents, against all damages,
claims, liabilities, losses, and other expenses, including without limitation attorneys' fees and related
costs, whether or not a lawsuit or other proceeding is filed, in any way arising out of (1) Winner's, or
any of its agent's, breach hereof, negligence, or willful misconduct; (2) Winner's, or any of its agent's,
violation of any applicable law, ordinance, rule, or regulation; or (3) any provision of inaccurate,
erroneous, or incomplete information by or on behalf of Winner hereunder or otherwise provided to
SRSTL. SRSTL shall provide Winner with prompt notice of any claim. SRSTL shall also cooperate
in all reasonable respects with Winner, its insurance company, and its legal counsel in its defense of
such claim at Winner's sole expense. Winner may not settle any potential suit hereunder without
SRSTL's prior written approval. If Winner fails to promptly indemnify and defend a covered claim,
SRSTL shall have the right to defend itself, and in such case, Winner shall promptly reimburse
SRSTL for all of SRSTL's associated costs and expenses.
2. Winner agrees to take the golf cart as-is and any warranties/claims are
made by, and the responsibility of, the manufacturer, not by SRSTL.
3. Winner shall pay all taxes and fees associated with the ownership of the golf cart.
4. Winner shall execute any and all documentation necessary:
a. To obtain ownership
b. To pay taxes and fees associated with the ownership; and
c. To effectuate all other terms of this agreement.
