AUCTION RULES 

 

1) All LIVE and SIlent auction items are sold 'as-is.  While every reasonable effort has been made to describe each item accurately, inadvertent mistakes can occur. 

2) Values listed, if any, of items offered for auction are donor's estimates and are not warranted by SMS.  

3) A bid constitutes a legal contract to buy.  You are required to pay for items for which you were the successful bidder. All sales are final.  Items are transferable but cannot be exchanged by SMS or the donor unless specifically noted that this is permitted  

4). Please be aware of and adhere to item expiration dates.  Please do not request extensions from the donor.  

5) Buyers and those using the purchased items assume all responsibility for its use.  SMS is not liable for injuries, losses, or other claims from the redemption or use of any auction item.

6) SMS reserves the right to withdraw any item before or during the sale and shall have no liability whatsoever for such withdrawal.  

7) We reserve the right to reject any bid.  The highest bidder acknowledged by the auctioneer during the LIVE auction will be the purchaser.  In the event of any dispute between bidders, or in the event of doubt on the part of SMS as to the validity of the bid, the auctioneer will have final discretion either to determine the successful bidder or to re-offer and resell the article in dispute.  If a dispute arises after the sale, SMS records are conclusive. 

8) All items should be paid for on the evening of the event.  You have the opportunity to process your cart/checkout at your convenience, otherwise all purchases will be cleared by the GiveSmart software at 10:00 on the evening of the event.

9) Please pickup your items on the scheduled pickup date at SMS, or make other arrangements ahead of time.  Items not claimed within 7 days will be donated.
