Give For Greatness Silent Auction
1. Boys & Girls Club of Metro Atlanta ("BGCMA") includes BGCMA's Corporate Board, Trustees, Board of Directors, Senior Leadership, staff, employees, agents, donors, representatives, volunteers, and all those aiding BGCMA with the Auction.
2. All bidding in the silent auction will be processed electronically through GiveSmart, our auction service. Bidders must register with GiveSmart on-line to bid in the auction. Once the bidder has registered, the bidder will receive a text message. The bidder must click the link in the text message to access a personal bidding site, to browse items, and to place bids in the silent auction.
3. When registering, the bidder will be given the option to enter a credit card. The bidder's card will not be charged unless the bidder completes a purchase, makes a donation, or wins an auction item. All electronic payment information is encrypted and secured. The bidder may change their method of payment at any time.
4. After the bidder has bid on an item, GiveSmart will send the bidder a text message if they are outbid. The bidder can also place a maximum bid and the auction software will automatically raise the bid to keep the bidder in the lead until the bidder's maximum bid has been met or the silent auction ends. Bidders are encouraged to place maximum bids so that they do not risk getting outbid at the last second.
5. To ensure optimal fundraising, all auction items have a minimum bid below which they cannot be sold, as noted in the on-line bidding system.
6. At the close of the silent auction, all winning bidders will be notified by email and text message. All sales and winnings are final. There are NO EXCHANGES, REFUNDS, TRANSFERS, OR SUBSTITUTIONS, except where specified. Gift certificates are for merchandise and services only as stated and cannot be redeemed for cash. Restaurant gift certificates generally do not include tax, gratuity, alcohol, or parking.
7. Before bidding, please read all specifications, restrictions, and limitations. Each person who bids on an item assumes all risks and hazards related to the silent auction and items obtained at auction.
8. Unless otherwise noted, all auction items must be used within one (1) year of the auction. Trips sold in partnership with GiveBack Sports may be used within two (2) years of the auction. Unspecified dates and times are subject to availability and mutual agreement by the donor and winning bidder. If an item has an expiration date, it is the responsibility of the winning bidder to comply with the expiration dates and to finalize transactions within the time frames specified on the item certificate. All taxes, applicable fees, or reservations are the responsibility of the successful bidder.
9. While every reasonable effort has been made to describe each item correctly, ALL ITEMS AND SERVICES ARE SOLD OR WON "AS IS." BGCMA neither warrants nor represents, and in no event shall be responsible for, the correctness of descriptions, genuineness, authorship, provenance or condition of the items.
10.BGCMA reserves the right to withdraw or add any item before or during a sale and shall have no liability whatsoever for such withdrawal or addition. BGCMA reserves the right to reject any bid.
11.These rules constitute BGCMA's entire agreement with the purchaser. Together with the purchaser's invoice, these rules are the complete and only terms and conditions on which all items are offered for sale. A bid constitutes a legal contract to buy. The winning bidder is required by law to pay in full for the item for which the purchaser was the successful bidder.
12.The auction item values listed are estimates of fair market value ("FMV"). Values of items offered for auction are donor's estimates and are not warranted by BGCMA. Items have not been appraised unless so noted. The amount the purchaser pays above the FMV estimate may be tax deductible as a charitable contribution. Determining the appropriate deduction is the responsibility of the purchaser. Please consult your tax adviser to clarify amount of deduction.
13.All sales are offered according to the laws of the State of Georgia, and any and all disputes or complaint arising from the auction, items, or events shall be adjudicated in binding arbitration in the state of Georgia, Fulton County by the American Arbitration Association.
14.To the extent any of the above terms are found to be unenforceable, the purchaser agrees that the adjudicating party shall be permitted to amend such claims to comply with the intent of the parties, which is to provide the non-profit BGCMA with the broadest protection available for this fundraising event.
