INSPiRE CHICANO PRIDE RIDE 2026
WAIVER, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY
As consideration for being allowed to participate in the INSPiRE Chicano Pride Poker Ride (the "Event") on May 2, 2026, I, the undersigned, agree as follows:
1. I represent and warrant that I am of sound mind and body and have the authority and ability to enter into this agreement. I certify that I am physically fit with no known physical or mental impairment and have prepared for participation in the Event.
2. I acknowledge that motorcycle activity, including my participation in the Event, is a potentially hazardous activity which can be a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by my own negligent actions, terrain, traffic conditions, road conditions, facilities, temperature, weather, condition of rider's equipment, mechanical defects, vehicular traffic, and actions of other people including, but not limited to organizers, participants, vehicle drivers, members of the public, volunteers, spectators, INSPiRE, its officers, agents, directors, employees, heirs and assigns (together, the "INSPiRE Parties"). These risks are not only inherent to riders, but are also present for passengers, spectators and volunteers.
3. I further acknowledge that Coronavirus ("COVID-19") infections have been confirmed throughout the United States, including in Colorado and the Denver Metro Area. INSPiRE has advised me to comply with all local mandates in effect in the locales I may frequent during the event. INSPiRE is not responsible for my actions or the actions of other Event participants, or my decision to participate in this Event. Accordingly, I acknowledge that potential COVID-19 infection is a risk associated with the Event and my participation therein.
4. I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING, VIEWING AND/OR VOLUNTEERING IN THIS EVENT. I HEREBY RELEASE, WAIVE, AND DISCHARGE THE INSPIRE PARTIES FROM ALL LIABILITY RESULTING FROM MY PARTICIPATION IN THE EVENT. I PROMISE NOT TO SUE AND AGREE TO PAY ALL COURT COSTS AND ALL ATTORNEY FEES THAT RESULT FROM MY ACTION, CIVIL OR OTHERWISE. THE PROVISIONS OF THIS PARAGRAPH SHALL APPLY REGARDLESS OF THE FORM OF ACTION, DAMAGE, CLAIM, LIABILITY, COST, EXPENSE, OR LOSS ASSERTED, WHETHER IN CONTRACT, STATUTE, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE. I ACKNOWELDGE THIS RELEASE AND DISCHARGE APPLIES TO LIABILITY THAT MAY ARISE FROM NEGLIGENCE OR CARELESSNESS ON THE PART OF THE LAEF PARTIES.
5. I acknowledge that this Waiver and Release of Liability Form will be used by the Event holders, sponsors and organizers of the Event and that it will govern my actions and responsibilities at said Event. I certify that I am not and will not be under the influence of any narcotic, alcohol or other drug that may impair my understanding or judgment and that I will not at any time during the Event operate my motorcycle under the influence of any narcotic, alcohol or drug. If I choose to imbibe alcohol or take any drug, I do so at my own risk and I am solely responsible for my actions. I certify that I have fully adequate insurance to cover all medical claims, the motorcycle and any other equipment and any damage or liability I may ultimately be found responsible for, during all travel to the point of my entry into the Event, the Event, the period between the end of the Event and my return to my final destination. I further certify that I have all the insurance required by law and I am licensed and competent to operate a motorcycle in a safe manner and my license has all motorcycle endorsements or certificates required by the State of Colorado or the state of my residence. To the extent that I do not have such insurance, I understand that I am not permitted to participate in the Event, and if I somehow do so I take the risk of not being able to recover for any injuries that I or my equipment, including my motorcycle, may sustain.
6. In consideration of my being permitted to participate in the Event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) waive, release and discharge from any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me during the Event or during my traveling to and from this Event, the INSPiRE Parties and (B) indemnify and hold harmless the INSPiRE Parties from any and all liabilities or claims made by other individuals or entities as a result of any of my actions during this Event. THE FOREGOING INDEMNIFICATION OBLIGATION SHALL APPLY REGARDLESS OF WHETHER THE CLAIM ALLEGES A BREACH OF CONTRACT, VIOLATION OF STATUTE OR TORT (INLUDING WITHOUT LIMITATION NEGLIGENCE) BY THE INSPiRE PARTIES.
7. Accordingly, I do hereby release and discharge the INSPiRE Parties from all claims, demands, and causes of action of every kind whatsoever for any death, damages and /or injuries which may result from my participation in the Event. This shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
8. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident and or illnesses during the Event. I agree to pay for any and all costs related to medical response, treatment and transport on my behalf.
9. I certify I will wear the personal protective equipment while operating my motorcycle at this Event that is or may be required by the United States and the State of Colorado and that my motorcycle and all required personal protective equipment are in safe operational condition. I agree to abide by all traffic laws, the rules of the road, and the directions/rules given by the organizers of the Event, and I understand that my privilege to ride may be removed without refund if I am in violation of the rules set forth or acting/performing in an unsafe manner, or any manner disruptive to the operation of the Event.
10. I certify I am at least 18 years old. I know that I can talk to a legal advisor about this Agreement and I have either done so or chosen not to. I understand that I have the right and have been given the opportunity to object to and bargain about the provisions of this Agreement.
I hereby certify that I have read both pages of this Waiver and Release of Liability in its entirety. My signature below indicates that I fully understand it and agree to its contents and that I am voluntarily signing this agreement.
